What Is Probate And How Does It Impact California Real Estate?
Probate is the legal process that takes place after a person passes away. The probate process typically begins by filing a petition for probate with the court in the county where the deceased person lived. It involves validating the will of the deceased, collecting assets, paying debts, and distributing the remaining assets to the beneficiaries named in the will. If there is no will, the probate court will appoint an executor or administrator to manage the estate, and they will be responsible for handling the following tasks:
1. Identifying and collecting all assets belonging to the deceased person.
2. Paying off any debts, taxes, and expenses owed by the estate.
3. Distributing the remaining assets to the beneficiaries named in the will, or to the heirs if there is no will. During the probate process, the court will also oversee any disputes that arise, such as challenges to the validity of the will or disagreements among the beneficiaries. The probate process can be lengthy, taking anywhere from several months to several years, depending on the complexity of the estate and any disputes that arise.
